Transactions concluded through our site

Contracts for the supply of financial services formed through our Site or as a result of visits made by you are governed by our terms and conditions.

You agree to provide us with all relevant proof of identification that we reasonably request, including proof of identity and proof of nominated bank current account and associated debit card.

  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.

You also agree:
  • Not to reproduce, duplicate, copy or re-sell any part of our Site in contravention of the provisions of our terms of website use.
  • Not to access without authority, interfere with, damage or disrupt:

Suspension and Termination

We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our Site. When a breach of this policy has occurred, we may take such action as we deem appropriate.

Viruses, hacking and other offences

You must not attack our Site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.

Linking to our site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link from any website that is not owned by you.

Jurisdiction and applicable law

The English courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our Site.

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

In the event that you are resident outside England and Wales (for example in Scotland) we will issue proceedings through the applicable local Court.

We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our Site.

Competitions Terms and Conditions

If you take part in any quiz or competition offered on our website or by our affiliates, the following rules will apply:

Terms & Conditions of submitting an image into a Western Circle Limited competition:

By submitting a photo to a Western Circle Limited competition, you are confirming the following:

  1. I am sending you my photograph which I am happy for Western Circle Limited (and its advertising, promotion and other agencies) to use in its advertising, marketing, publicity or promotional materials. I therefore grant you a worldwide license to the use of my photo and all personal details entered;
  2. I am over 18;
  3. I am the owner of the photo and am able to grant this license to use it;
  4. I am giving permission on behalf of myself and any others who are seen in the photo and I confirm that they agree to this licence;
  5. This permission covers all forms of use including without limit television, print, online (including Western Circle Limited website and social channels), newspapers, magazines, digital and social media and all other forms of media now and in the future anywhere in the world;
  6. The licence is irrevocable and the period of usage is unlimited;
  7. Use of the photo will not infringe any rights (such as intellectual property, privacy, confidentiality or data protection) belonging to others;
  8. The photo is original and is not a copy of anyone else’s work;
  9. I agree that this licence is royalty-free;
  10. If requested by Western Circle Limited, I will sign (and arrange for the others in the photo to sign) any documents to confirm the above;
  11. I hereby agree to defend, indemnify and hold Western Circle Limited harmless from and against any and all losses, and all claims by third parties, resulting from your breach of any of the these terms and conditions;
  12. The details I have submitted are true;
  13. English law applies.

By entering your photo for your chance to win a money prize you agree to be bound by these terms and conditions:

  1. Notification of photos to be used: Finalists, and later the winner, will be notified by email. All entrants must ensure they provide a valid email address and must be contactable on the same email address used for entry.
  2. Western Circle Limited will not be responsible for the non-receipt of any entry and cannot be held liable for entries which are lost or not received or which cannot be sent due to technical or service issues or for any other reason. Proof of submitting an entry will not be accepted as proof of receipt by Western Circle Limited.
  3. As entries may be displayed in marketing material which will be in the public domain entrants must ensure that only suitable material is uploaded. Entries must not contain any material which is defamatory of any person, or is obscene, offensive, discriminatory, illegal, hateful or inflammatory; be threatening, abusive or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety; or be likely to harass, upset, embarrass, alarm or annoy any other person. Western Circle Limited reserves the right to refuse any entry which it considers contravenes these provisions or for any other reason at its absolute discretion.
  4. Western Circle Limited reserves the right to vary these terms and conditions at any time, or to withdraw the competition altogether at its discretion.
  5. Western Circle Limited decision is final in connection with all matters arising from this competition and no correspondence will be entered into. Western Circle Limited accepts no responsibility, liability or any consequences whatsoever for entrants participating in this competition.
  6. These terms and conditions are governed by English law.
